A
conservation easement is a legal agreement between a landowner and
a land trust that permanently limits a property's uses in order
to protect its conservation values. The agreement is tailored to
protect the land's conservation values and meet the financial and
personal needs of the landowner.
When land is owned, many rights associated with it
are also "owned", such as the rights to harvest,
build structures, sub-divide parcels, create roads, and so on. When
individuals donate or sell a conservation easement to a land trust,
some of those rights are permanently restricted. Future owners will
also be bound by the terms of the easement.
